Commercial Manager MEPH in London, London, United Kingdom

My client is responsible for the biggest rail construction project in Europe, helping to improve London's commuter infrastructure.
Due to an increase in project workload they require two Commercial Managers to hit the ground running and join on a short term contract.

Purpose

Assist the Project Commercial Manager in relation to the development and implementation of a Contract Management Program for the project consistent with Contracts Management Policies and Work Processes, Procedures and Systems; checking that commercial and contract issues are dealt within the Project at the lowest level cognisant with the delegated authorities; deputising for the Project Commercial Manager when requested and performing duties allocated by the Project Commercial Manager for the successful commercial management of the project goals and objectives.

Tasks within the role will include but are not limited to the following;

  • Analysing the contract terms and conditions to highlight areas of risk; such as ambiguities, conflicts or deviations from the scope of work; As work proceeds make recommendations on the mitigation of these risks; monitor performance and Supporting remedial actions.
  • Analysing NEC contract documentation and producing a Contractor and Project Team deliverables schedule. Monitoring performance against this schedule and recommending corrective actions.
  • Developing and managing appropriate mechanisms to monitor compliance with contract terms and conditions.
  • Working with the other Project Team members to check that actions or inactions which could result in constructive contract changes are identified and suggesting possible ways of resolving the situation.
  • Developing and managing a procedure to recognize and identify contract disputes as they develop and manage the timely resolution under the changes provisions wherever possible, obtaining claims and legal expertise as appropriate.
  • Maintaining a working relationship with Construction, Engineering, Procurement, Legal and Risk Management to facilitate organizational interfaces between those performing (sub)contract administration
  • Providing analysed contract performance, quantities, cost and schedule data within the Project
  • Business Team.
  • Checking that the Project adheres to contract insurance provisions and that any requirements in this regard are implemented.
  • Checking that second-tier procurement is undertaken in accordance with all policies and procedures.
  • Checking that contemporaneous records are kept, and correspondence, instructions, and communications are crafted in accordance with the contract terms and issued within the prescribed time limitations.
  • Checking that records and data are kept up to date on the appropriate systems and trackers.

Challenges of the Job

  • Taking full responsibility for contract and commercial management of MEPH subcontracts.
  • Working alongside the Package Manager(s) and being full responsibility for the day-to-day management of MEPH subcontract packages. Providing support to the Senior Package QS and the Project Team through example, knowledge and ability to influence and in so doing encouraging project team members to work in accordance with requirements of corporate governance.
  • Being comfortable working at a detailed level and supporting this with the necessary written, numerical and verbal skills. Able to accept responsibility and accountability for the management of subcontracts through the full life cycle.
  • Supporting the Project Commercial Manager in providing the Project Team with reviews and analysis of the contract performance data.
  • Supporting the Project Commercial Manager in maintaining a working relationship with the Project, Functional and Corporate Teams.

Dimensions & Interfaces (both internal and external)

  • Reports to Project Commercial Manager.
  • No direct reports.
  • Works closely with Package Manager(s), Site Manager(s), Cost Engineer(s) and Field Engineer(s).

Person Specification

  • Degree in Engineering, Business, Quantity Surveying, Law, or Construction Management, or equivalent experience.
  • Construction experience on Crossrail or a mega Project is desirable.
  • Experience and courses in cost engineering, planning, risk, pricing, contract law, contract drafting, administration and negotiation of change orders, and effective correspondence.
  • Knowledge of contract administration (NEC 3), quantity surveying, home office and site procedures and documents relating to a large scale, multi-discipline construction project.
  • Working knowledge of engineering/construction industry contracting practices.
  • Significant experience of dealing with large MEPH works packages as needed.
  • Experience of operating strategically and commercially in numerous functional areas / matrix organisation.
