Commercial Manager
To provide leadership to the commercial team managing a large/complex project, section of a very large/complex project and/or large portfolio of framework contracts/multiple projects Optimises commercial performance, drives value added results whilst ensuring appropriate risk and reward mechanisms are in place. Key Interfaces: Key client commercial representatives the wider Rail Commercial community. Senior Operational roles on Projects/Contracts Procurement Project Partner Finance Project Partner Work Winning Project Partner Key Sub-contractors and suppliers. Safety & Sustainability Project Partner Project Administration Key Accountabilities:
- Ensuring the successful commercial performance of an extensive contract portfolio, section of a very large project, or single large project
- Developing and executing Commercial Strategy specific to the Contract Portfolio or Complex Project
- Identifying opportunities to maximize income and margin (commercial value creation) for the designated Project/Contracts
- Building and managing effective, lasting relationships (internal and external) to achieve high levels of customer satisfaction
- Providing commercial assurance through forecasting and identification of issues giving rise to commercial risk
- Managing and developing an ‘industry leading’ Commercial Team, allocating the appropriate level of skilled commercial resource to meet Project/Contract needs
- Ensuring potential disputes are identified and resolved as early as possible to mitigate scale and complexity of issues
- Contributing to the Safety Leadership of the Project/Contract
Role Profile
- Overseeing commercial audit and compliance and identifying areas for continuous improvement in processes.
- Manage compliance with processes and ensure quality standards are maintained across the team(s), recommending improvements where necessary
- Proactively manage the implementation of the behavioural safety programme and Sustainability 2020 Roadmap, across the team(s)
- Coach and manage others to ensure adherence to Values
- Manage, coach and develop talented teams to deliver high performance Key Responsibilities:
Preparation and implementation of a project specific commercial strategy to ensure robust Cost Management and challenge of any Project Monthly Reporting variances to achieve tendered commercial performance or better with no surprises.
Ensure robust Cost Control & Budget Management through the implementation of commercial review processes in accordance with the GMCE's and Commercial Manual monitored via commercial dashboards and take any corrective actions required.
Review and Challenge the “First Principle” detailed Forecast Cost to Completion and ensure it is underpinned by a fully resourced programme in accordance with GMCE requirements.
Review and Challenge Applications and verifiable Cash flow forecasts to ensure maximisation of cash position.
Pro-active Review and Challenge of Change Management and Claims change control outcomes whilst establishing and maintaining a collaborative culture with the client to achieve maximum trading position.
Ensure commercial risks are proactively identified, accurately and auditable quantified, are managed, mitigated and where possible eliminated on an ongoing basis in support of Risk Management implemented by the delivery team via a Project/Contract risk register.
Provision of expert Commercial Advice to commercial and project teams highlighting commercial best practice and regularly update Senior Management on Project/Contract contractual issues.
Build and ensure strong commercial team Client and Supply Chain Relationships working in a
Role Profile
Collaborative manner in accordance with the Code of Conduct, facilitating repeat business.
Identify key roles within Client organization and Develop Customer Relationships in line with wider strategy.
Drive Supply Chain Management with Procurement Project Partner to ensure Project / Contract strategy is met.
Ensure Project/Contract Compliance with legal / statutory / regulatory and code of conduct requirements by carrying out commercial Audits in accordance with the GMCE's and Commercial Manual.
Lead a customer focussed and collaborative commercial approach utilising excellent communication and expert negotiation skills to ensure Conflict Avoidance by proactive Dispute Management and Resolution.
Establish robust Delegated Financial Authority (DFA) framework and ensure ongoing compliance.
Define Project/Contract Recruitment needs and support by leading competency based interviews and ensuring a comprehensive induction is to be provided.
Develop People by defining and agreeing commercial team personal development plans and managing Professional Development.
Deliver Performance Management by ensuring commercial roles are clearly defined, understood and acknowledged with emphasis on leadership, accountability and responsibility, where performance targets, objectives and expectations are discussed, agreed and met with appropriate levels of coaching and support.
Undertake regular site visits (minimum 6 safety tours per annum) and site inspections to support Zero Harm action plans
Knowledge & Skills: Essential: The ability to operate successfully in a commercial environment, possessing the business acumen needed to develop commercial opportunity on projects to beat budget Full membership of a recognised Professional Institute (ie RICS or CICES) A detailed understanding of Contract Law and Insurances Detailed knowledge and understanding of sub-contracting principles

Rail Sector commercial experience
Experience: Essential: Desirable: Previous experience at senior level of managing project commercial performance, and a track record of delivering commercial excellence Experience of financial and commercial control within a project environment Experience of dispute resolution Experience of managing teams.
