Governance
- Provide a single point of responsibility for commercial contracts, agreements and activities within the contract lifecycle
- Ensure commercial standards, procedures and processes are applied across all operational commercial activities relating to the contract
- Ensure contract compliance with respect to company secretarial, insurance and treasury policies
- Ensure contract commercial compliance from a delivery perspective including an independent reviews/verifications
Leadership
- Ensure adequacy of commercial resources that underpin the achievement of the contract strategy & objectives (working with Commercial Services)
- Lead a team of contract managers to deliver required commercial outcomes
Sales & Bidding
- Commercial Lead on the project driving the development of the commercial strategy and developing commercial positions which optimally balance the division’s exposure to commercial risk with its appetite to win
- As Commercial Lead manage commercial negotiations with customers, partners, sub-contracts and financiers
- Where not acting as Commercial Lead, Project Board Member and commercial sign-off for all bids <£7.5m, Contract, Black Hat participant and contract commercial sign off for all other bids/projects
- Provide commercial input into market shaping activities for the Contract
- Review and approve commercial deliverables on behalf of the Contract
- Provide independent review for bid and re-bids within other Contract
Transition
- Establish Contract Management Framework including oversight of setup of financial & back office reporting, revenue determination process, contract performance management & reporting, standards & compliance & billing systems & customer reporting
- Contribute to any commercial negotiations with customer, sub-contractors, or partners during the transition phase
- Approval of commercial deliverables during contract handover
Operations
- Provide strategic commercial leadership & advice to the Contract management team and contract delivery teams
- Provide contract education and training at site level
- Responsible for leading and managing all operational commercial activities and solutions including: contract document management, contract performance management, contract change management, contract growth/scope management, sub-contractor /partner contract management, supplier standard T&Cs, customer/subcontractor/supplier contract negotiations
- Determine & drive commercial contract improvement initiatives including managing the impact of contract performance and abatement regime on pricing and profitability; developing mechanisms to improve profitability and reduce penalties
- Manage issues, claims and dispute resolution
- Deliver commercial reporting to satisfy Contract and Divisional objectives
- Engage and work with internal/external legal counsel as appropriate
- Ensure commercial risks and opportunities are identified and mitigated/managed
