What is the purpose of the role?

The purpose of the role is to keep AIW legal, as far as its Regulated obligations are concerned, by a) establishing and maintaining processes and systems and b) working closely with stakeholders.

The Track Access Manager will work with the Regulatory & Customer Manager to develop and achieve compliance with AIW’s Regulated obligations.

As a member of the management team, the Track Access Manager will contribute to AIW’s; performance improvement planning, client reporting, financial reporting, incident investigation, asset management, contract reviews etc

The Track Access Manager will deputise for the Regulatory & Customer Manager as required.

Key Accountabilities

The Track Access Manager will assist the Regulatory & Customer Manager in ensuring that access to the CVL Network, permitting operator and engineering access to it, is controlled in an independent, fair, reasonable and non-discriminatory manner.

The Track Access Manager will assist the Regulatory & Customer Manager in:

• Providing/maintaining all of the Regulated documents and associated contracts
• Being very familiar with:
• The Railways (Access, Management and Licensing of Railway Undertakings) Regulations 2016
• Railways Act 1993
• Competition Law
• CVL Network Statement
• CVL Network Code
• Access Disputes Resolution & Rules (ADRR)
• Delay Attribution Principles & Rules (DAPR)
• Track Access Contracts entered into
• Advising on the Law as Regulated by the ORR (including legal precedents and interpretation)
• Correcting any misconceptions and/or preventing actions that are not in line with the Law
• Ensuring track access harmony with Network Rail (particularly Network Rail’s SoAR Panel and Claims Panel)
• Ensure the Network, Station and Vehicle Change processes and the closure processes are being executed appropriately, including:
• Vetting all change proposals
• Coaching Project Managers on the requirements
• Running all consultations / representations and gathering comments from consultees to feed back to the relevant Project Manager
• Managing to conclusion any disputes arising
• Representing AIW at court hearings, ADC and/or at the ORR regarding track access
• Making any formal application to the ORR
• Establishing each change once approved
• Responding to consultations received as required
• Facilitating services as supplied by Network Rail under the CVL Services Agreement and the IM Agreement contracts eg:
• Capacity Allocation
• Access Disputes
• Operation of the “Performance Regime Operator” i.e. train delay attribution and dispute resolution upto and including Level 3, TAC Sch 4 & 8 processes inclu Sch 4 claims, operation of the Route Trading Model, operation of the freight/charter regime
• Operation of the TAC Schedule 9 Compensation Deed
• Provision of TABS data to AIW and relevant train operatorsThe Track Access Manager will also assist The Regulatory & Customer Manager on:
• Maintaining the following Regulated documents:
• Existing Track Access Contracts
• template Track Access Contracts
• Network Licence
• Network Statement (published in two languages)
• Framework Capacity Statement
• Network Code
• Railway Operations Code (short term and post transformation)
• Emergency Access Code (short term and post transformation)
• Depot Access arrangements
• Connection Agreements
• Network Change template letters
• Vehicle Change template letters (not Regulated)
• Sectional Appendix (not Regulated but is contractualised in each Track Access Contract)
• The stations Lease (to the SFO) incorporating the Stations Access Conditions with an annexe for each station
• Stakeholder Relations Code of Practice general
• Stakeholder Relations Code of Practice for new and potential operators
• Ensuring that track access costs per customer are invoiced
• Assist negotiations for new Track Access Contracts with new train operators
• Monitor payments in accordance with the IM Agreement contract
• Authorise periodic payment information so that money flows
• Creating opportunities and efficiencies (including the wider industry) whilst reducing risk

· Understanding of GB and EU law relating to rail

· UK contract law

· Good knowledge of rail industry / railway systems

· Good understanding of contractual railway (e.g. Track access agreements, Network Code, DAPR)

· Legally trained to degree level

Desirable

· Knowledge of Project Management techniques

· Membership of a relevant professional body with Chartered Status and/or educated to degree level
